RULES AND CONDITIONS OF THE EXHIBIT

  1. The artist must certify that he/she is the exhibitor and the artist. If someone else is exhibiting the work of the artist, this must be stated in the application. If the show staff deems that the work is not consistent with the photos presented, they may not allow those pieces to be displays or not allow the artist to exhibit. All work created by the artist, originals and reproductions, are permitted in the exhibition. 
  2. The work exhibited at the show must be consistent with the photos submitted in the application process.
  3. The exhibitor’s booth must be open and staffed during all hours of the exhibit.
  4. Consignments, imports, antiques, kit work, production work and/or any work which is not wholly the original design and work of the applicant are strictly prohibited. 
  5. An application is a commitment to show.  No full refunds will be given after the acceptance notice is sent.  Partial refunds will be given if cancellation notice is received three weeks prior to the exhibition date.
  6. All art and jewelry items displayed must be for sale.
  7. All artwork should be in keeping with the family theme of the exhibit.
  8. Exhibitor’s booth must be situated so as not to hinder or interfere with other Exhibitor’s booths.  All of the exhibitor’s booth and display, including chairs, must be placed within the confines of the space.
  9. Kahn Development is not liable for paying any travel expenses, lost revenue or any other liability whatsoever beyond the space fees paid by the exhibitor if problems arise and the exhibitor is asked to leave.
  10. Spaced not occupied by 9:30 am of that day may be filled with standby Exhibitors with no refund or allowance whatsoever.
  11. The exhibition opens at 10:00 a.m.  and closes at 6:00 p.m. Artists should be ready to greet customers at 10 a.m. and the booth should remain open until 6:00 p.m.  Artists who fail to remain at their booth until the official closing time will not be invited to participate in additional art exhibitions.
  12. All exhibits, art and materials must be removed by 9:00p.m the day of the exhibit.
  13. Exhibitors shall be liable for delivery, handling, erection, and removal of their own displays and materials.
  14. Exhibitors may use available spaces nearest to the exhibit site. Exhibitors MUST then move their vehicles to the the designated area as shown on the provided map. (click here)
  15. Exhibitors must abide by all regulations and/or decisions by the local fire or police or representatives at the Festival.
  16. Exhibitors are requested not to bring pets to the exhibit.
  17. There is no electricity available for exhibitors.
  18. Exhibitors may not sublet or appropriate their space to anyone else. 
  19. TOWNE PLACE at GREENBRIER OR KAHN DEVELOPMENT will not be responsible for refunds or any liabilities whatsoever for the failure to fulfill this contract due to weather, or by any act of God, public enemy, statuettes, ordinances, or any legal authority, or any cause beyond its control.
  20. Insurance, if desired by the Exhibitor, must be obtained at their own cost.
  21. Taxes, Laws - All exhibitors are responsible for collecting and reporting their own Virginia State Sales Tax.  The collection and payments of permits, licenses, taxes, etc. shall be the sole responsibility of the Exhibitor. 
  22. Artists may have to show a license or ID to the City of Chesapeake.
  23. Acceptance, exhibit fees, payment process and deadlines - Once exhibitor has been approved and accepted, the application/contract constitutes a legally binding agreement with the exhibitor and Towne Place at Greenbrier & Kahn Development.  Exhibitor will forfeit booth space reservation if fees are not paid in full or if the bank has returned checks.  RETURNED checks for non-sufficient funds act as an automatic cancellation.  A reinstatement fee of $50 would need to be paid in cash to allow the Exhibitor to set up.
  24. This contract constitutes the entire agreement between TOWNE PLACE at GREENBRIER & KAHN DEVELOPMENT and the exhibitor and no modification shall be valid unless in writing and signed by the parties or their representatives.
  25. This contract is made in the State of Virginia and shall be interpreted in accordance with the laws of Virginia.  In the event that legal action is required to enforce this contract, or any of the terms thereof the rules of the State of Virginia will govern. 

Failure to comply with these rules may result in expulsion from the show without refund.

Applicants should note that this is an outdoor exhibition, therefore subject to the whim of Mother Nature. If the exhibit is cancelled due to a weather emergency, no refund will be issued! Artists should plan to bring with them a sturdy tent with proper weights and means of securing it against the elements. 

To protect the property of nearby artists, the Exhibition staff may ask artists to add extra security to their tents and/or displays.
